Terms & Conditions

    1. Introduction: After5 (the “App”) is a mobile application operated by Rock IT Express Inc. (“After5,” “we,” or “us”) under Philippine jurisdiction. After5 connects users (“you,” “your,” or “User”) to verified, independent service providers for on-demand repair, maintenance, and emergency services, including plumbing, electrical, air conditioning, locksmithing, and automotive support beyond regular business hours.

    These Terms and Conditions (“Terms”) form a binding legal agreement between you and After5. By using the App, including downloading, installing, accessing services, or creating an account, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

    1. Eligibility: You must be at least eighteen (18) years of age and have full legal capacity to enter into contracts under Philippine law. By using the App, you represent and warrant that you meet these eligibility requirements and that all information you provide is accurate and complete.
    2. Account Registration and Responsibilities: You must register an account to use After5. You agree to provide accurate, complete, and current information and to update it as needed. You are responsible for keeping your login credentials secure. You must notify us immediately of unauthorized use of your account. You are responsible for all activity under your account. We may suspend or terminate accounts with inaccurate or fraudulent information.
    3. Services and Transactions: After5 is a technology platform. We do not employ or control service providers. Each service booked through the App is a separate, pay-per-job transaction. There are no subscription fees. Service providers are independent contractors responsible for the work they perform. Service providers acknowledge and agree, upon registration with the platform, that they are not employees, agents, or representatives of Rock IT Express. We do not guarantee service availability, quality, or completion time. We facilitate introductions; we are not a party to service agreements.
    4. Payments: You agree to pay for services as agreed in the App, including applicable taxes and fees. Payments are processed through secure third-party platforms and must be made in Philippine pesos (PHP). Accepted payment methods include credit/debit cards and e-wallets (GCash, PayMaya). We do not store full payment data. You authorize After5 or its partners to charge your selected payment method for all approved charges.
    5. Body Camera Policy: Service providers are equipped with body cameras for safety and accountability. By requesting a service, you consent to being recorded. You will be notified when recording is active. Footage is encrypted, securely stored, and accessed only by authorized personnel for dispute resolution, safety, or regulatory compliance. Recordings are retained for a period of thirty (30) days from the date of service completion, after which they are permanently deleted, unless required to be preserved longer in connection with an active complaint, legal obligation, or investigation, in accordance with the Philippine Data Privacy Act and NPC guidelines.
    6. User Conduct: You agree to use the App lawfully and respectfully. You must not:
    • Engage in fraud, harassment, abuse, or illegal activity;
    • Post offensive, defamatory, or harmful content;
    • Upload viruses or harmful code;
    • Impersonate others or misrepresent your identity;
    • Reverse-engineer, copy, or exploit the App;
    • Interfere with the App’s operation or bypass security;
    • Misuse the review or rating system.

    Violations may result in suspension or termination without prior notice.

      1. Termination: We reserve the right to suspend or terminate your account at any time for breach of these Terms, misuse of the App, or illegal conduct. Except in cases involving fraud, criminal activity, or imminent harm to the platform or its users, we shall provide you with reasonable prior notice and an opportunity to respond before effecting termination. Upon termination, your rights to use the App immediately cease, and we may delete your data subject to legal and privacy obligations.
    • Complaints and Refunds:

    Users may submit service-related complaints and refund requests within forty-eight (48) hours of the completion of the booked service. Complaints must be filed through the in-app support feature, via email at customerservice@after5.ph, or through the designated hotline. The User shall provide the booking reference, a description of the issue, and any supporting evidence such as photographs, relevant screenshots, or timestamps from body camera recordings where applicable.

    Upon receipt of a complaint, After5 shall acknowledge the claim within twenty-four (24) hours and conduct a reasonable investigation, which may include communication with the service provider, review of service records, and examination of any available media. A resolution shall be issued within seven (7) business days, unless extended by necessity.

    Refunds may be granted at the sole discretion of After5 under the following circumstances:

    1. Non-appearance or unjustified failure to complete the service by the provider;
    2. Verified instances of substandard, unsafe, or negligent service delivery;
    3. Erroneous or unauthorized charges;
    4. Provider misconduct, breach of policy, or unlawful conduct.

    Refunds shall not be granted where dissatisfaction arises from personal preference, incomplete or inaccurate information provided by the User, or cancellation outside allowable windows. All approved refunds will be processed through the original payment method and may take up to thirty (30) business days to reflect, depending on the payment provider. Repeated or malicious filing of baseless complaints may result in account suspension or termination, at the discretion of After5.

    1. Disclaimers and Waivers: The App is provided “as is” and “as available” without warranties of any kind. We do not guarantee uninterrupted service or the outcome of services booked through the App. Service providers are independent; we do not control their conduct. By using the App, you accept the risks associated with hiring independent professionals and waive claims against After5 for issues arising from their services.
    2. Limitation of Liability: To the fullest extent allowed by law, After5 shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the App. This includes but is not limited to loss of profits, data, or personal injury. Our total liability shall not exceed the amount you paid for the relevant service.
    3. Privacy: Your privacy is governed by our Privacy Policy, which forms part of these Terms. By using After5, you consent to our data practices as described in that policy.
    4. Governing Law: These Terms shall be governed by the laws of the Republic of the Philippines. Any disputes shall be subject to Philippine law and resolved in accordance with Section 13.
    5. Dispute Resolution: All disputes, controversies, or claims arising out of or relating to these Terms or the use of the App shall be resolved exclusively by the proper courts of Quezon City, Philippines. The parties waive any other venue to which they may otherwise be entitled by virtue of domicile or other considerations. Each party shall bear its own legal costs and expenses unless otherwise ordered by the court.
    6. Intellectual Property: All App content (text, images, software, logos) is owned by Rock IT Express or its licensors and protected by Philippine intellectual property laws. You may not reproduce, modify, or use any content without permission.
    7. License to Use: We grant you a limited, non-exclusive, revocable, non-transferable license to use the App on your personal device for lawful purposes. This license does not permit resale, redistribution, or commercial exploitation of the App or its content.
    8. Prohibited Actions:

    You must not:

    • Modify, copy, or reverse-engineer the App;
    • Interfere with App functionality;
    • Access systems without authorization;
    • Circumvent security or authentication features.

    Such conduct will result in termination and possible legal action.

    1. Service Provider Obligations:

    Service providers must:

    • Be qualified, licensed, and insured as required;
    • Wear After5 identification and uniforms;
    • Keep body cameras active during service;
    • Perform services professionally and safely;
    • Avoid discrimination or misconduct;
    • Follow applicable laws and After5 standards.

    By registering on the App platform, each service provider expressly acknowledges and affirms that they are operating as an independent contractor and not as an employee, agent, or partner of After5. Nothing in these Terms shall be construed to create an employment or agency relationship.

    Violations may lead to deactivation from the platform.

    • One-Time Password (OTP) Authentication:

    For purposes of account verification, security, and user authentication, the Company may transmit a One-Time Password (“OTP”) via Short Message Service (“SMS”) to the mobile number provided by the User during registration, login, or when conducting certain transactions within the App. By submitting a mobile number, the User expressly authorizes the Company to send OTPs and other transactional messages for identity verification and related security measures.

    The User acknowledges and agrees that the provision of an accurate and accessible mobile number is required for proper authentication and continued access to the App’s features. Standard message and data rates may apply as determined by the User’s mobile service provider.

    1. Amendments: We may update these Terms from time to time. Continued use of the App constitutes acceptance of the revised Terms. Material changes will be communicated through the App or email.
